These terms set out how KrakenGo works: what we do, what the boat operator does, how a request becomes a charter, what you pay and when, and what happens if plans change. Please read them before you send a request.
1.About these terms
krakengo.com is operated by [COMPANY LEGAL NAME], registration number [COMPANY REGISTRATION NUMBER], VAT number [VAT NUMBER], registered office [REGISTERED ADDRESS]. You can reach us at [CONTACT EMAIL].
By using the website or sending us a charter request you agree to these terms. If you do not agree, please do not use the website. If you act for a company or a group, you confirm that you are authorised to accept these terms for them.
2.Definitions
- Website: krakengo.com and every page and service on it.
- We, us: [COMPANY LEGAL NAME], trading as KrakenGo.
- You, Customer: the person who uses the Website or requests a Charter.
- Operator: the owner or professional charter company that operates a Boat and provides the Charter.
- Boat: any vessel listed on the Website.
- Charter: the hire of a Boat for an agreed period, either bareboat (without crew), skippered, or fully crewed.
- Request: the form you send from a Boat page to ask for specific dates.
- Hold: the period during which the Operator keeps your dates reserved while the Charter is being arranged.
- Charter Agreement: the written contract for a specific Charter, signed by you and the Operator.
- APA: advance provisioning allowance, a sum paid before a crewed Charter to cover running costs such as fuel, food, drink and berthing.
3.Our role
KrakenGo is a charter intermediary. We present Boats on behalf of Operators, help you choose, and arrange the Charter between you and the Operator. Unless a Charter Agreement names us as the Operator, we do not own, manage, crew or operate the Boats.
The contract for the Charter itself is the Charter Agreement between you and the Operator. If the Charter Agreement and these terms say different things about the Charter, the Charter Agreement applies, except that it cannot take away the cancellation rights we promise in Cancellation and changes.
4.Who can use the Website
You must be at least 18 years old and legally able to enter into contracts. The details you give us must be true, complete and your own. Tell us promptly if they change.
You agree not to:
- send Requests you do not genuinely intend to pursue, or on behalf of someone who has not agreed;
- copy, scrape or republish the listings, photographs or position data without our written permission;
- interfere with the Website, probe it for weaknesses or try to access data that is not yours;
- use the Website for anything unlawful.
We may refuse a Request or block access where these rules are broken.
5.Listings, prices and the live map
Boat descriptions, specifications, photographs and equipment lists come from the Operators. We check them with care, but small differences are possible: equipment is replaced, a refit changes a layout, and a photograph may show a sister ship of the same model. The specification attached to your Charter Agreement is the one that counts.
A price shown as “From” is the lowest weekly rate for that Boat, usually in low season. The estimate on a Boat page is a guide worked out from that rate and your dates. Neither is a binding offer. Your actual price depends on the season, the length of the Charter and the extras you choose, and is confirmed in a written quote. Boats marked “On request” are priced for each enquiry.
Unless your quote says otherwise, the charter fee does not include fuel, marina and mooring fees, food and drink, final cleaning, tourist or cruising taxes, a skipper or crew for a bareboat, transfers, or the security deposit. VAT depends on the country and the type of Charter and is shown in your quote.
6.How booking works
- Request. You choose dates on a Boat page and send a Request. Sending a Request is free, takes no payment and does not yet bind you or the Operator.
- Hold. We ask the Operator to confirm the dates. Once confirmed, the dates are held for you for up to 14 days. Availability on the Website is not updated in real time, so a Hold only exists once we have confirmed it to you. If the Boat is not free we will tell you and suggest alternatives.
- Concierge. We aim to contact you within 24 hours of your Request to go through the route, the crew, the extras and the price.
- Charter Agreement. You receive a written quote and the Charter Agreement, including the Operator’s own conditions. Please read them before you sign.
- Confirmation. The Charter is confirmed when you have signed the Charter Agreement and the deposit has been received. If that has not happened by the end of the Hold, the dates are released.
You can drop a Request or a Hold at any time before signing, at no cost.
7.Price and payment
No payment is taken on the Website. When you sign the Charter Agreement a deposit of 30% of the charter fee is due. The balance is due on the date stated in the Charter Agreement, before embarkation. Payments are made by bank transfer or another method named in the Charter Agreement, to the party named there. We will never ask you to pay into a personal account or to send card details by email.
For crewed Charters an APA, typically 35% of the charter fee, is paid before embarkation. The captain keeps an account of what is spent. Anything left over is returned to you at the end of the Charter, and if spending goes beyond the APA you settle the difference before disembarking.
If a payment is late the Operator may treat the Charter as cancelled by you under Cancellation and changes, after giving you written notice and a reasonable chance to pay.
8.Security deposit and insurance
For bareboat and skippered Charters the Operator takes a refundable security deposit at check-in, or offers a non-refundable damage waiver in its place. The amount is stated in your quote. The deposit is returned after check-out if the Boat comes back on time, undamaged and with its inventory complete.
The Operator insures the Boat as described in the Charter Agreement. That insurance does not cover your personal belongings, your travel, your health, or the cost of cancelling. We strongly recommend travel and cancellation insurance, and for bareboat Charters a skipper liability policy.
9.Your responsibilities
- Bareboat Charters. The skipper must hold the sailing licence and radio certificate required in the country of the Charter, and have the experience to handle the Boat, with at least one competent crew member. The Operator may refuse to hand over the Boat, without refund, if the skipper is clearly not able to sail it safely. A professional skipper can usually be hired instead.
- Documents. You provide the crew list and licences by the date we ask for them, and everyone on board carries valid travel documents and any visas they need.
- On board. You keep to the maximum number of guests, the agreed cruising area and the law. On a crewed or skippered Charter the captain has the final word on anything that affects safety, including the route and the weather.
- Use. The Boat is for private leisure. No racing, towing, sub-letting, paid passengers, or transport of illegal goods, unless the Operator has agreed in writing.
- Care and return. You look after the Boat, report damage or faults to the Operator straight away, and return the Boat at the agreed place and time.
10.Cancellation and changes
If you cancel
- Before you sign the Charter Agreement: free. Nothing is owed.
- 60 days or more before embarkation: free. The charter fee you have paid is refunded in full.
- Fewer than 60 days before embarkation: the cancellation charges in your Charter Agreement apply. They are shown to you before you sign. If the Operator is able to re-let the Boat for the same dates, the charges are reduced by what the Operator recovers.
To cancel, write to [CONTACT EMAIL]. The date we receive your message is the date of cancellation. Refunds are made to the account the payment came from, within 14 days.
A Charter is a leisure service for specific dates, so the statutory 14-day right to withdraw from a distance contract generally does not apply. The cancellation rights above apply in its place.
If you want to change something
Ask us as early as you can. We will do our best to change dates, Boat or guest numbers, but changes depend on availability and may change the price.
If the Operator cancels or the Boat is not available
If the Boat cannot be provided, for example after damage on a previous Charter, you will be offered a Boat of similar or better standard for the same dates. If you would rather not accept it, or none can be found, everything you have paid for the Charter is refunded in full.
Events outside anyone’s control
If the Charter cannot go ahead because of an event described in Events outside our control, you may choose between new dates and a refund of what you have paid for the Charter. Ordinary bad weather is part of sailing and is not such an event, although the captain or the Operator may change the route or delay departure for safety.
11.Availability of the Website
We work to keep the Website available and accurate but do not promise that it will be free of interruptions or errors. We may change, suspend or withdraw any part of it, for example for maintenance. Confirmed Charters are not affected.
12.Liability
We are responsible for performing our own service, which is arranging the Charter, with reasonable care and skill. The Operator is responsible for the Boat, its condition, its crew and the Charter itself, under the Charter Agreement.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that the law does not allow to be limited. If you are a consumer, nothing in these terms takes away rights that the law of your country of residence gives you and that cannot be waived.
Subject to that, we are not liable for losses we could not reasonably have foreseen, for losses caused by events described in Events outside our control, or for business losses such as lost profit. For customers acting in the course of a business, our total liability for a Charter is limited to the fees we earned for arranging it.
13.Events outside our control
Neither we nor the Operator are in breach where performance is prevented or delayed by something beyond reasonable control, such as war, terrorism, civil unrest, government or port authority orders, epidemics, natural disasters, exceptional weather warnings issued by the authorities, strikes by third parties, or the failure of public networks. The affected party must tell the other promptly and do what it reasonably can to limit the effect.
14.Intellectual property
The KrakenGo name, logo, design, text and software belong to us or our licensors. Boat photographs and descriptions belong to us or to the Operators. You may view and share pages for your own personal use. Any other use, including automated copying, needs our written permission.
15.Personal data, cookies and marketing
Our Privacy Policy explains how we handle your personal data and our Cookie Policy explains what the Website stores in your browser. We send the newsletter only to people who have subscribed, and every issue has an unsubscribe link.
16.Changes to these terms
We may update these terms. The version published on the day you send a Request applies to that Request, and the Charter Agreement you sign is not affected by later changes.
17.General
If a court finds part of these terms invalid, the rest continues to apply. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms to someone else without our agreement. These terms are written in English. If we provide a translation and it differs, the English version applies.
18.Complaints, governing law and courts
If something goes wrong during a Charter, tell the captain or the Operator’s base at once so it can be put right on the spot, and tell us as well. For any other complaint write to [CONTACT EMAIL]. We reply within 14 days and will always try to settle the matter directly with you. If we cannot, you and we may agree to use a mediator, and consumers may turn to the alternative dispute resolution body of their country of residence.
These terms are governed by [GOVERNING LAW, e.g. the laws of Greece], and disputes are heard by [COMPETENT COURTS, e.g. the courts of Athens]. If you are a consumer living in another country, you keep the protection of the mandatory laws of that country and you may also bring proceedings in your local courts.
