This policy explains what personal data KrakenGo collects when you use krakengo.com, why we collect it, who receives it and what you can do about it. We have tried to keep it short and specific to what this website really does.
1.Who is responsible for your data
KrakenGo is operated by [COMPANY LEGAL NAME], registration number [COMPANY REGISTRATION NUMBER], with its registered office at [REGISTERED ADDRESS] (“KrakenGo”, “we”, “us”). We are the data controller for the personal data described in this policy.
For anything about your personal data, write to [PRIVACY EMAIL].
2.The data we collect
Data you give us
- Charter requests. When you hold dates on a boat we receive your name, email address, phone number if you add one, the boat, your dates and the number of guests.
- Enquiries. When you use the contact form we receive your name, email address, the months you are considering, your group size and whatever you write in the message.
- Newsletter. Your email address, if you subscribe.
- Correspondence. Emails, calls and messages you exchange with our concierge team.
- Charter paperwork.If you go ahead with a charter, the documents a charter legally requires: a crew list (full names, dates of birth, nationalities and passport or ID numbers of everyone on board), and for a bareboat charter the skipper’s sailing licence and radio certificate.
Please do not send us sensitive information we have not asked for. If you tell us about a dietary, mobility or medical need so that a crewed charter can be prepared for it, we use that information only for that purpose and only with your consent.
Data collected automatically
- Server logs. Like every website, our hosting records your IP address, browser type, the pages requested and the time of each request.
- Your cookie choice and a small number of strictly necessary items stored in your browser. The full list is in our Cookie Policy.
We do not run advertising trackers or third-party analytics on this website, and we do not buy data about you from anyone.
3.Why we use it and on what legal basis
| Purpose | Data used | Legal basis |
|---|---|---|
| Responding to your charter request or enquiry, checking availability, preparing a quote and holding your dates | Contact details, request details, correspondence | Steps taken at your request before entering into a contract |
| Arranging and administering a confirmed charter, including passing the required details to the boat operator and port authorities | Contact details, charter paperwork | Performance of a contract and legal obligations that apply to charters |
| Sending the newsletter | Email address | Your consent, which you can withdraw at any time with the unsubscribe link |
| Loading interactive maps | IP address and an identifier stored by the map provider | Your consent, given through the cookie banner |
| Keeping the website secure, preventing abuse and fixing faults | Server logs | Our legitimate interest in running a safe and reliable service |
| Keeping accounting and tax records, and handling complaints or legal claims | Booking and payment records, correspondence | Legal obligations, and our legitimate interest in defending our rights |
Where we rely on legitimate interest you may object at any time (see Your rights). You are never obliged to give us data, but without contact details we cannot answer a request, and without the charter paperwork a charter cannot lawfully go ahead.
5.Transfers outside the European Economic Area
We keep personal data within the European Economic Area where we can. Some providers, Mapbox among them, are based in the United States. When data leaves the EEA we rely on an adequacy decision of the European Commission where one exists, and otherwise on the Commission’s standard contractual clauses. You can ask us for a copy of the safeguards that apply.
If your charter takes place outside the EEA, the operator and the local authorities there necessarily receive the charter paperwork. That transfer is needed to perform the contract you asked for.
6.How long we keep it
| Data | Kept for |
|---|---|
| Requests and enquiries that do not lead to a charter | 24 months after our last contact with you |
| Confirmed charters, invoices and payment records | [NUMBER REQUIRED BY LOCAL TAX AND ACCOUNTING LAW] years after the charter, as tax and accounting law requires |
| Crew lists and copies of licences | Until the charter has ended and any claim period has passed |
| Newsletter subscription | Until you unsubscribe |
| Server logs | Up to 12 months |
| Cookie choice | 6 months, then we ask again |
When a period ends we delete the data or make it anonymous. We keep data longer only while a dispute or legal claim is open.
7.How we protect it
The website is served over an encrypted connection, access to customer data is limited to the people who need it to arrange your charter, and our providers are chosen for their security standards. No system is perfectly secure. If a breach ever puts your rights at risk we will tell you and the supervisory authority as the law requires.
Email is not a secure channel. Please do not email card numbers or full copies of identity documents unless we have given you a secure way to do so.
8.Automated decisions
We do not make decisions about you by automated means and we do not profile visitors. The price estimate shown on a boat page is simple arithmetic based on the dates you pick. It is the same for everyone.
9.Your rights
Under data protection law you can ask us to:
- confirm whether we hold data about you and give you a copy;
- correct data that is wrong or incomplete;
- delete your data, where we have no lawful reason to keep it;
- restrict how we use it while a question is being resolved;
- hand over the data you gave us in a portable format;
- stop using it where we rely on legitimate interest, and stop any direct marketing;
- withdraw a consent you gave, without affecting what was done before.
Write to [PRIVACY EMAIL]. We may need to confirm your identity, and we answer within one month. Exercising your rights is free.
If you are unhappy with our answer you can complain to [DATA PROTECTION AUTHORITY OF THE COMPANY'S COUNTRY], or to the data protection authority of the country where you live.
10.Children
KrakenGo is for adults. You must be at least 18 to request a charter, and we do not knowingly collect data from children other than the crew list details a parent or guardian provides for a family charter.
11.Links to other websites
Our pages may link to other websites, such as a marina or a tourist board. Those sites have their own privacy policies and we are not responsible for how they handle your data.
12.Changes to this policy
We will update this policy when what we do with data changes. The date at the top shows the current version. If a change is significant and we have your email address, we will tell you before it takes effect.
